Abstract

This research examines the implementation of laws related to abortion in Indonesia, focusing
on the provisions in the Criminal Code and Law No. 36 of 2009 concerning Health, as well as
its impact on law enforcement in abortion cases by paramedics. The purpose of this research
is to find out the practice of illegal abortion by paramedics. The research method uses a
normative juridical approach, this study analyzes primary and secondary data to understand
the effects of illegal abortion practice by paramedics. The results showed that in Decision
Number 31/Pid.Sus/2020/PN.Tdo, the punishment for midwives involved in abortion in the
fetus with perfect physical condition and 6 months of age is very light and unfair, considering
the right to life of the fetus.
